Politics on the Go (POGO) Inc.

Effective Date: September 8th, 2026

These Terms & Conditions (“Terms”) govern your access to and use of https://www.pogovote.com, the POGO web application, and related services provided by Politics on the Go (POGO) Inc. (“POGO,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your account credentials and for activity occurring under your account. You may not impersonate another person or create an account using information that is false or misleading.

If you are under the age required to legally consent to a particular activity under applicable law, you may use the Services only with any consent or supervision required by law.

2. The POGO Service

POGO is a civic engagement and information platform designed to make elections, candidates, issues, ballots, and civic opportunities easier to understand and navigate. Features may include candidate and issue information, personalized civic content, ballot research, surveys, polls, events, organization information, communications, and other tools.

POGO may add, modify, suspend, or discontinue features at any time. Some features may be available only in certain locations, during certain elections, or to certain users.

3. Civic and Election Information

POGO is intended to help users research and engage with civic information. POGO does not provide legal, financial, investment, medical, or other professional advice.

Election rules, deadlines, candidate positions, ballot information, polling information, government records, and other civic information can change. POGO works to provide accurate and transparent information, but you should verify time-sensitive election information with the relevant official government or election authority before making a voting or other civic decision.

POGO is nonpartisan. The appearance of a candidate, organization, issue, advertisement, sponsorship, partnership, or other content in the Services does not necessarily constitute an endorsement by POGO.

4. User Content

If you submit content to POGO, including comments, survey responses, poll responses, feedback, photos, text, or other materials (“User Content”), you retain ownership of your User Content. You grant POGO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify as necessary for technical purposes, display, and otherwise use User Content as reasonably necessary to operate, improve, and provide the Services, subject to our Privacy Policy and any specific terms presented when you submit the content.

You are responsible for the User Content you submit and must have the rights and permissions necessary to submit it.

5. Acceptable Use

Do not use the Services for unlawful, fraudulent, abusive, threatening, harassing, or deceptive purposes.

Do not interfere with or attempt to compromise the security or operation of the Services.

Do not scrape, crawl, harvest, or systematically extract information from the Services except as expressly permitted by POGO or applicable law.

Do not attempt to access accounts, systems, or data that you are not authorized to access.

Do not use the Services to distribute malware, spam, unsolicited bulk messages, or other harmful content.

Do not impersonate POGO, its employees, partners, candidates, public officials, or other persons or organizations.

Do not use POGO's messaging services to send messages to people who have not provided the required consent.

6. SMS and Text Messaging Terms

If you separately opt in to receive POGO text messages, these SMS Terms apply to that messaging program.

Program: POGO may send text messages containing civic and election information, account or service notifications, reminders, responses to requests, event or community information, and other messages specifically associated with the program for which you opted in.

Consent: SMS consent is voluntary and is not a condition of creating an account, using POGO, purchasing anything, or accessing the Services. You may use available non-SMS methods to access the Services where offered.

Frequency: Message frequency varies based on the program and your interactions with POGO.

Rates: Message and data rates may apply.

Opt out: Reply STOP at any time to unsubscribe from the applicable POGO SMS program. After you send STOP, POGO will stop sending messages covered by that opt-out, except for a permitted confirmation message.

Help: Reply HELP for assistance or contact POGO at [INSERT SUPPORT EMAIL/PHONE].

Re-enrollment: If you later want to receive a program after opting out, you may need to provide new express consent.

Carriers: Carriers are not liable for delayed or undelivered messages.

Privacy: POGO does not sell or share mobile phone numbers, SMS opt-in data, or consent records with third parties or affiliates for their own marketing or promotional purposes. See the POGO Privacy Policy for additional information.

By providing your phone number and separately affirmatively opting in to a POGO text messaging program, you consent to receive recurring automated text messages from POGO at the number provided for the specific program identified at the time of enrollment.

7. Intellectual Property

The Services, including POGO's software, design, branding, logos, text, graphics, interfaces, and other content created by POGO, are owned by or licensed to POGO and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from POGO's proprietary materials.

8. Third-Party Content and Services

The Services may include information, links, integrations, or services provided by third parties. POGO does not control and is not responsible for third-party content, products, services, policies, or availability. Your use of third-party services may be governed by separate terms.

9. Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information. By using the Services, you acknowledge that you have reviewed the Privacy Policy.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. POGO DISCLAIMS WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

POGO does not warrant that the Services will be uninterrupted, error-free, secure, or complete, or that civic, election, candidate, polling, ballot, or other information will always be current or accurate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POGO'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO POGO FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

12. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless POGO and its officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses arising out of your violation of these Terms, your User Content, or your misuse of the Services.

13. Suspension and Termination

POGO may suspend or terminate your access to the Services if we reasonably believe you violated these Terms, created risk or legal exposure for POGO or others, engaged in fraudulent or abusive activity, or for other legitimate operational reasons. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will post updated Terms and revise the Effective Date. Your continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by law.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of [INSERT STATE], without regard to conflict-of-law principles, except to the extent federal law or applicable consumer protection law requires otherwise. Any dispute-resolution provisions, including venue, arbitration, or class-action provisions, should be reviewed and finalized by POGO's counsel before publication.
